By accessing or using FidoHQ ("Fido," "we," "our," or "us"), including our website, application, and services at fidohq.ai, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

FidoHQ is an AI-powered funding-readiness service that helps small business owners understand their cash flow, prepare funding applications, connect banking data, and receive financial analysis and guidance. Our services include:

• AI-guided funding-readiness chat and financial analysis
• Funding application preparation and submission to lending partners
• Bank account connections via Plaid for transaction and balance data
• Business accounting connections via Xero for aggregated profit-and-loss and balance-sheet data
• Cash-flow dashboards and lender-preparation guidance

3. Account Registration

You must create an account to use Fido. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. An account may contain multiple company workspaces, and you are responsible for ensuring you are authorized to manage each company you add.

4. Financial Data and Third-Party Services

Fido connects to third-party services to provide its features. By using these integrations, you also agree to their respective terms:

• Plaid: We use Plaid to connect your bank accounts and retrieve transaction data. Your use of Plaid is subject to the Plaid End User Privacy Policy.
• Xero: If you connect a Xero organization, you authorize Fido to access its organization details, profit-and-loss reports, and balance-sheet reports to provide accounting insights and AI-powered analysis. You represent that you are authorized to grant Fido access to that organization. We store encrypted authorization credentials and aggregated accounting snapshots, not raw Xero reports, contacts, invoices, or bills. You may disconnect Xero at any time. Your use of Xero remains subject to Xero's Terms of Use.
• LendFlow: Funding applications you submit through Fido are processed by our lending marketplace partner. We transmit your business and personal information to facilitate loan matching.
• Stripe: Payment processing is handled by Stripe. Your payment information is sent directly to Stripe and is not stored on our servers.

5. AI-Powered Features

Fido uses artificial intelligence to provide financial analysis and conversational guidance. AI-generated content is for informational purposes only and does not constitute financial, legal, or tax advice. You should consult qualified professionals before making financial decisions.

AI responses may be inaccurate. While we strive to provide helpful and relevant information, AI-generated content — including financial analysis, business guidance, and application assistance — may contain errors, omissions, or outdated information. You should independently verify any information, figures, or recommendations provided by Fido before relying on them to make business or financial decisions. FidoHQ is not liable for any actions taken based on AI-generated content.

Fido does not predict loan approval odds, guarantee interest rates, or provide specific financial advice.

6. Acceptable Use

You agree not to:

• Provide false or misleading information in funding applications
• Use the service for any unlawful purpose
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the service
• Use automated means to access the service beyond its intended interfaces

7. Subscription and Billing

Certain features of Fido require a paid subscription. Billing is handled through Stripe. By subscribing, you authorize us to charge the payment method on file at the applicable rate. You may cancel your subscription at any time through your billing settings.

8. Intellectual Property

FidoHQ and its content, features, and functionality are owned by FidoHQ and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you provide through the service.

9. Limitation of Liability

To the maximum extent permitted by law, FidoHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the service.

Fido is not responsible for decisions made by third-party lenders, the terms of any loan offers received, or the outcome of any funding applications submitted through the platform.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your access to the service at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the service ceases immediately.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on our website. Continued use of the service after changes constitutes acceptance.
